Q. How many employees
do I need to have to be covered by the Fair Labor
Standards Act?
A. If you are engaged in interstate
commerce and meet the requirement for
amount of business being done, you can be covered if you have
as few as one
employee.
Q. Do I have to pay employees
while they are on their break?
A. If the break is a rest period
of less than 20 minutes duration the
employee must be paid for that time. If the break is a meal
period of
greater than 20 minutes and the employee can leave the premises
if he or she
wishes to do so the employer does not have to pay the employee.
Q. What is meant by the term
"exempt"?
A. The term "exempt"
is used to describe a class of employees who for
various reasons are not covered by (therefore "exempt")
the FLSA. Employers
are not required to pay overtime to "exempt" employees.

A. The FLSA is enforced by the
